To speed up the formalities for imports and exports of the foreign-funded enterprises, accelerate and facilitate the goods to go through Customs, and in accordance with the relevant State's preferential policies, the Customs exercises supervision and control over import and export of goods of foreign-funded enterprises, mainly as follows:

The machinery and equipment, raw and processed materials, fuels, bulk parts, spare and component parts, primary parts and fittings imported to perform the export contracts including those exportation of which is restricted by the State are exempted from application for import licenses and placed under the supervision of the Customs against the enterprises' contracts or import-and- export contracts.


Bonded Factories

Bonded factories can be set up in larger export-oriented foreign-funded enterprises if they apply for, but subject to the approval of the Customs. During the period of Customs control over the raw and auxiliary materials and other materials imported for the production of export products, the duty payment can be made at a later time.

The essential conditions to the establishment of a bonded factory are as follows:

a. to be equipped with special facilities for processing and manufacturing export products;

b. to have special warehouses for storing, placing imported materials, parts and finished export products;

c. to set up special book accounts to record information concerning production, sales and stockpile of export products;

d. to designate special persons in charge of the bonded goods, warehouses and book accounts.

The establishment of bonded factories shall be approved by the local Customs authority upon the on-the-spot survey.


Credit Worthy Enterprises

Foreign-funded enterprises with law-abiding operations and good credits can be approved by the Customs as Credit-Worthy Enterprises after reviews on applications and more facilities will be provided in Customs procedures including the priority in customs declarations, inspection and clearance for import and export goods. Besides, import goods for these enterprises can be examined by their own obligatory supervisors but subject to the Customs re-inspection if deemed necessary by the Customs, and clear the Customs in advance, before customs declarations of aggregated amount of goods at regular intervals.


Customs Registration -- Enterprises

The following documents to be submitted for enterprise registration with the Customs:

a. an enterprise registration form;

b. a duplicate copy of the approval for the establishment of the enterprise by the approving authority;

c. a duplicate copy of the approval certificate;

d. a certified copy of the business license of the legal person, affixed with the valid seal of the Administration for Industry and Commerce at county or higher level.

e. a certified duplicate copy of the investment application form (exempted for the joint ventures or cooperative enterprises ), affixed with the across-perforation seal by the approving authority;

f. a certified duplicate copy of the contract (exempted for wholly foreign-owned) and articles of association of the enterprise, affixed with the across-perforation seal of the approving authority;

g. a certified duplicate copy of the feasibility study report, affixed with across-perforation seal of the approving authority;

h. a duplicate copy of the Confirmation of Enterprises with Investments from Hong Kong, Macao, Taiwan Compatriots or Overseas Chinese, issued by the relevant examining and approving authorities;

i. to register for self customs declaration, application shall be delivered with the specimen of the special seal for the Customs declaration and the handwritings of persons in charge of declaration.

j. other relevant documents required under the Customs regulations.


Customs Registration -- Representative Offices

The documents to be delivered for the registration for customs declaration by representative offices are as follows:

a. an application form for registration of customs declaration enterprise;

b. an enterprise registration form;

c. a duplicate copy of the approval for the establishment by FIEC;

d. a certified duplicate copy of registration card affixed with the valid seal of the Administration for Industry and Commerce.

To facilitate the import and export of foreign-funded enterprises, the Customs Administration has approved to set up six Customs Brokerages in Luhai Company, Xingxia Company, Construction and Development Company. International Trade Corporation, SEZ Trading Company and Foreign Trade (Group) Company to undertake the customs declarations for import and export. Customs brokerages render services such as computer data input for the completion of customs declaration forms, package services of customs declaration, examination, transportation and warehousing of goods as well as consultancy for Customs procedures.
